This practically focused webinar will explore the proper exercise of trustee discretion when one or more of the trustees is a beneficiary of the trust. We will also have a Q&A session at the end addressing pre-submitted questions from the audience.
In this session, we will consider how trustee decisions can reflect “… discretion being exercised with an entire absence of indirect motive, with honesty of intention, and with a fair consideration of the subject.”
We will also provide practical guidance regarding recording decisions where a trustee / beneficiary cannot be party to the decision by reference to the CCH precedent trustee resolution and the recent High Court decision in Cain v Martin.
