What Business Licenses and permits do I need to operate in New York?
Businesses must meet all licensing and registration requirements in order to legally operate in New York State. The state is responsible for regulating and issuing licenses and permits for a number of businesses and professions through the Department of State, state boards, and other agencies. Businesses may also need to obtain local licenses and permits for each jurisdiction in which it operates. There may also be licensing and registration requirements at the federal level.
Here are examples of business licenses, permits, and registrations you may need in New York state:
- Sales Tax Certificate of Authority: Businesses making sales that are subject to New York State sales tax must register with the Tax Department to obtain a Certificate of Authority. If you have multiple business locations in New York, the state requires that you have a Certificate of Authority for each location.
- Professional/occupational licenses: Certain services and professions require licensing at the state level. For example, a retail store that conducts food preparation may need to obtain a Food Processing Establishment License from the New York State Department of Agriculture and Markets. An architect wishing to practice in the state must obtain a professional license from the New York State Education Department, Office of the Professions.
- Special state permits: The sale of products such as alcohol and lottery tickets require special state-issued permits and licenses.

How do I get a business license in New York?

What kind of licensing or stamp requirements do I need to be able to distribute cigarettes in New York, if I am purchasing the cigarettes from Virginia Manufacturer?
You must be a licensed wholesale dealer of cigarettes in New York if you intend to sell to a retail tobacco dealer or other persons for the purpose of resale. You must be licensed as a cigarette agent to purchase and affix New York State cigarette tax stamps. Cigarette agent licenses may be issued to dealers (wholesalers or retailers) who maintain separate warehousing facilities for receiving and distributing cigarettes and conducting their business, and who have received commitments from at least two cigarette manufacturers whose aggregate market share is at least 40% of the New York State market. To be a Wholesale Dealer in New York City you must first acquire a state license and then apply for a city license. A state tax stamp is evidence that the state excise tax was paid. If you wish to affix the City cigarette and sales tax stamps on cigarette packs which are sold to wholesale dealers in New York City (Agent-Jobber), you must, in addition to being licensed by the state, be licensed by the City. Do out of state collection agencies need to obtain the Yonkers, NY license?
The City of Yonkers, N.Y requires all collection agencies obtain a license.
(Article XVIII) Section 31-158 of the Yonkers Consumer Protection Code states, "It shall be unlawful for any person or business to operate a debt collection agency without first procuring a license from the City of Yonkers."
According to the director of the Consumer Protection Bureau for the city, as confirmed by CT Corporation, the licensing requirement applies to:
- Any debt collection agency located in the city of Yonkers; or
- Any debt collection agency attempting to collect from a resident of Yonkers.
The license fee is $150 for a one-year term.
New York does not currently have a statewide licensing requirement, although recent legislation suggests that could change by 2015. Currently, New York City and Buffalo, NY, also require local debt collection agency licenses.

How do I obtain a Reinsurance Brokerage License?
In order to obtain a Reinsurance Brokerage (or Reinsurance Intermediary Broker) license an applicant must generally: (1) Complete a NAIC Uniform Individual Application to be registered with the National Insurance Producer Registry; and (2) Pay both the state license application and state license fee. For non-resident applicants, a certification from their home state is often required as well. However, different states have requirements that vary depending upon their respective jurisdiction.
Some states have simplistic requirements. In Massachusetts an applicant must: (1) Complete an application form; and (2) Write a check made payable to the Commonwealth of Massachusetts, Division of Insurance, in the amount of $200.00. For non-resident applicants, a Certificate of Good Standing from your home state indicating you are licensed in good standing as a reinsurance broker is required as well. In Florida, an applicant must: (1) Complete an application for the license and submit appropriate fees. In addition, the applicant must be fingerprinted. Each person applying for the first time in Florida and qualifying for a license as a reinsurance broker shall attach a full detailed credit and character report for the 5-year period immediately prior to the date of application.
Some states have stringent requirements. In Georgia, applicants need to file a Certification Application for Certified Reinsurer. The applicant must be domiciled and licensed to transact insurance or reinsurance in what is called a "Qualified Jurisdiction." A qualified jurisdiction is a jurisdiction that is 1) an accredited jurisdiction in accordance with the NAIC financial and standards accreditation program; 2) qualified by the Commissioner as a qualified jurisdiction in accordance with the standards set forth in Ga. Reg. § 120-2-78-.08(3)(b); or 3) is a jurisdiction that is designated as a qualified jurisdiction by the Reinsurance Task Force, or working group thereof, and published through the NAIC Committee Process. The application fee is $600 for the initial application, and $700 for an annual renewal. There is a litany of additional requirements for licensure as well.
