Individual cosmetologists, estheticians and manicurists are licensed by the state, generally by the state’s board of cosmetology or equivalent regulating body. Education, experience and passage of state exams are often prerequisites to licensure. Salons and businesses employing individual cosmetologists may also need to obtain a license from the state board of cosmetology.
Cosmetic distributors and manufacturers are licensed by the state department of health or board of pharmacy. This type of business is often categorized in the same way as the distribution or manufacturer of drugs. Registration on the federal level with the Food and Drug Administration may be required. Distributors and manufacturers must also be cognizant of basic business licenses and sales tax registration.
Businesses functioning without the proper license are generally penalized based on the size of the operation and the gravity of the offense.
