She graduated with honours in 1975 from the Faculty of Law and Administration of the University of Warsaw. Her master thesis on the effectiveness of enforcement of maintenance claims written under the guidance of prof. dr. hab. W. Czachórski was published by the publishing house of the University of Warsaw in a collective study on family law (1976). In 1979, successfully completed her judge training with the ”very good” result. In 1986, passed the legal adviser exam with the “very good” result as well.
In the years 1991–2004 she was a member of the Studies and Analysis Office of the Supreme Court (formerly the Jurisprudence Office), and afterwards until 2005 – legal adviser at the Supreme Court.
By order of the President of the Republic of Poland of July 15th, 2008, appointed to exercise the function of judge of the Supreme Court. She adjudicates at the Chamber of Labour, Social Security and Public Affairs.
In the years 2014–2020 she was the First President of the Supreme Court.
She has conducted extensive scientific research at the University of Warsaw since graduation in 1975. Since that year she has also been employed by the Faculty of Law and Administration, currently as a professor of this university. In December 1981, defended her PhD dissertation entitled "Conclusion of a Contract of Employment" (Warsaw 1985), for which she obtained the award of the Minister of Science and Higher Education. In March 2003, Małgorzata Gersdorf's postdoctoral colloquium was approved by the Faculty of Law and Administration of the University of Warsaw and the Faculty Council unanimously awarded her a postdoctoral degree. The basis for the initiation of the habilitation process was constituted by the monograph entitled “Employer's Insolvency in Labour Law” (Warsaw 2002). The title of habilitated doctor was conferred in June 2003. The professorial dissertation was dedicated to ”Employment Law” (Warsaw 2013). In March 2015 awarded the title of professor of legal sciences.
At the University of Warsaw, she has held numerous honours: from January 1st, 1992 until August 31st, 1993, acted as Vice-Director of the Institute of Legal and Administrative Sciences at the Faculty of Law and Administration of the University of Warsaw; as of September 1st, 1993, served as Associate Dean of this Faculty for two consecutive terms; in the years 2000–2012, member of Senate Committees of the University of Warsaw (including Chairperson of the Legal and Statutory Committee); in the years 2008–2009 performed the function of Head of Labour Law and Social Insurance Study at the Faculty of Law and Administration of the University of Warsaw; as of 2006 has headed the Section of Non-Contractual Employment Relationships at this Faculty; in the years 2005–2008 filled the role of Vice-Provost of the University of Warsaw; from September 2008 until 2012 exercised the function of Senator at the University of Warsaw, as well as Chairperson of the Legal and Statutory Senate Committee. Currently, she acts as Head of the Department of Labour Law at the Faculty of Law and Administration of the University of Warsaw.
Małgorzta Gersdorf has also held numerous public functions: in the years 1989–1991, member of the Social Conciliation Commission, appointed by the Minister of Labour by the Act of May 24th, 1989, on the restoration of employee rights for persons deprived of employment for trade union activity, local authority activity, political and religious beliefs; in the years 1990–1992, performed the function of adviser to the Liquidation Commission of RSW "Prasa-Książka-Ruch"; in the years 1992–1996 - adviser to the President of the Confederation of Polish Employers on labour law and social security, as well as a participant in subsequent General Conferences of the International Labour Organization on behalf of the CPP; in the years 1992–1996, member of the Polish delegation to the International Labour Organization (ILO) Conference in Geneva; as of 1996, member of the Civil Service Qualification Committee, appointed by the Prime Minister for a 5-year term; in the years 2003–2005, member of the Legislative Council of the Prime Minister.
A member of NSZZ "Solidarność" from the establishment of the union in 1980 until being appointed the Vice-Provost of the University of Warsaw in 2005.
Deputy editor-in-chief of the journal “Praca i Ubezpieczenie Społeczne” and a member of the editorial board of “Przegląd Sądowy”, from March 1997 until 2003 editor-in-chief of “Przegląd Ubezpieczeń Społecznych i Zdrowotnych”.
Małgorzata Gersdorf’s academic achievement spans over 200 publications on various issues of individual and collective labour law and social security, including seven scientific monographs and several commentaries. Author of several dozen popular science works and legal essays.
